I had a neighbor few miles down the road from me get into an accident with his rust-free J10. Someone ran a red light because they decided texting their boy toy was more important than stopping, I guess. These things happen and unfortunately, there is always a victim.

Unfortunately I have been getting a very stiff neck and headaches. Could have been worse though.

Not exactly. Getting an estimate from an independent shop would be one potential point of a case/argument. 

 

I have asked for a copy of the estimate they received from the shop. They have failed to provide that as of their most recent response.

I don’t know how exactly all of the insurance stuff works in CA, but you might be able to go through your insurance and then your insurance will go after the other insurance company for payment. My parents have had to do this twice in WI, once with a person who failed to provide accurate insurance info to the police several times and another time when they got hit by an uninsured driver. Neither case resulted in their insurance rates going up. 
Being that their insurance company is dragging this out, it might be worthwhile to call your agent and see what you can do.

If the repair costs are more than the write off value, they won't really budge over that.

 

For some of these rigs, you'd really be better off with an "agreed value" policy.  It costs more but you get the agreed value covered instead of whatever blue book is

That's only an option if you carry collision / full coverage.

I could stop trying to make a deal with the insurance company and instead file a lawsuit against the guy who actually hit me. Then his insurance company would have to pay for his defense in court, which would cost them a lot more than it would take to make me happy.

Man, I know neck pain.  Currently on Short-term disability from work due to neck surgery.  I suffer pain and stiffness as I write this.  Neck issues is no joke, man.  I plan on doing extra strengthening of this sucker as soon as I fully recover.

 

Shame about your truck, my Brother.

Thanks man. This week has been rough for neck stiffness and headaches. Ultimately no amount of money would be enough if this is my new life.
