Old truck of mine was impounded...read this and vote

hey all...here's a funny story alot to read but its good:

 

about 2yrs ago i sold my 86 toyota 4x4 that i was involved in an accident with and totaled it...bent frame etc. I sold it to a guy, gave him the title and yada yada. Now about 3wks ago he calls me and says he sold the truck to another guy and this other person lost the original title with my name on it. The person i sold it to never renewed the title and just gave it over which then it got lost. Anyways i went to MVD and got a duplicate title and registration and voided the other one and tried to contact the guy i sold it to so he could get everything to person C. Now on saturday i got a letter from the Phoenix police saying that the 86 toyota had been pulled over and impounded due to expired registration and the driver having no license at all. So i called and they said i have no liabilty since i filed a vehicle sold notice with MVD but also said that after 30 days that i can come down pay the storage fees and get it back....I'm going down tomorrow to take a look and see if its worth it but what should i do about it??? I'm thinking of getting it and then selling it to a buddy of mine and making some money off it jamminz.gif

You might want to get some legal advice on this, but since you sold it, you don't have a right to just pay the storage on it, since you don't technically own it. I would definately look into all the legal aspects, as the person who was arrested is the owner, or the person you sold it to is... even though you own it on paper.

 

BTW it is always a good idea to notify the department of Motor vehicles if you sell or junk a vehicle

My vote is in the minority, probably because I have been involved with problems associated with "sold" vehicles. You have no idea what your truck may have been involved in while others had it. People driving a vehicle that can't be traced back to them tend to do things.......

ask the right questions, and cover your @$$. I see no inherent problem with paying storage fees to get it back. if it's impounded now, and he's in jail/has been arrested/ticketed, the police have done the follow-up already and any legal issues with the vehicle should be taken care of.

 

I would say if the impound fees are waaaaaay less than the value of the truck, then do it. but check your rights first.

You have been contacted by the police because you are the legal owner of the vehicle on paper since last registered. You are not liable for any accidents or crimes that the vehicle may have been involved in especially since you filed papers saying that the truck had been sold and noting the date. Whether the guy driving the vehicle at the time it was impounded has legal issues or just money issues he will not be able to get the vehicle released from impound without your permission. The police are going to require that the title be properly transferred and that any and all fees are paid prior to the truck moving off the lot.

 

If I were you I would go down to the yard and assess the trucks condition plus I would get an estimate of the charges that will accumulate on the truck until the 30 days are up. Leave your number with the impound yard in case mr. C shows up to try to claim it he will need your help anyway. Most people in his situation will just leave the vehicle there in which case you can pick it up and do whatever you want to with it.

 

In Texas they look very dimly on people who purchase vehicles and do not properly transfer the titles especially if they are driving the vehicle on the streets. It is different if it is a project stuffed in your garage but remember to keep all papers in a safe place and my dad keeps copies of the papers with the cars.

i spoke with the phoenix police and MVD today and after 30 days in impound i have the legal right to get the truck since i "paper own it" but the guy driving it has to deal with the legal ramifications. I have no legal liability towards what he did since i filed a "vehicle sold notice" with MVD 2yrs ago and just recently when the person i sold it to notifyed me of the lost title. I covered my @$$ quite fast so nothing could happen to me. I agree with what everyone is saying about it and right now after the 30 days i will pay about 450 to get it out..i wanna look first but i might just leave it for auction and give the city the duplicate title...i got my MJ so I'm good :cheers:

the frame is straight but does need all the crap cleaned out, tires, hood and interior redone but all in all its in ok shape...better than when i sold it lol lemme know what yall think

 

also when i was down there i spotted an 88 MJ 4x4 4.0l auto going up for auction at the end of the month...too bad i can't afford that one too jamminz.gif

yea ill try to post a pic of it...the sad thing is i had taken a picture of it the day b4 my accident...i loved my yota...only got stuck twice in about 300 trips with it all over the state and that was because i snapped a cv shaft...i love my MJ tho...much more versitile
